Development Stage Notice: This company is currently in development. Final company registration details will be added before public launch.

BY ACCESSING OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE, YOU MAY NOT USE THE SERVICE.

We may modify these Terms anytime. Material changes will be communicated via notice on the Service or email at least 30 days before the effective date. Continued use after changes constitutes acceptance.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that:

  • Create multiple accounts to circumvent limits
  • Use automated means to create accounts

4. Description of Service

DecorViz AI is a browser-based AI-powered SaaS platform that attempts to help users visually preview furniture and decor items in their real rooms before purchasing. Features include:

  • Upload Room Photos and Product Images
  • AI-generated photorealistic Previews with simulated lighting, shadows, and perspective
  • Single-item previews only (no multi-item layouts)
  • Before/after comparison sliders when generation succeeds
  • Variable performance across room types and products

The Service is strictly visual and aesthetic. It is not a measurement, fit verification, scale-accurate, construction, purchasing decision, or professional design tool. No guarantees regarding accuracy, realism, scale, fit, safety, or real-world matching.

5. Acceptable Use Policy

5.1 Permitted Use

Use the Service only for lawful purposes in accordance with these Terms.

5.2 Prohibited Conduct

You may not:

  • Upload illegal, harmful, abusive, defamatory, obscene, or sexually explicit content
  • Upload images of identifiable individuals without consent or that violate privacy rights
  • Upload content that infringes intellectual property rights
  • Use the Service to harass or harm others
  • Impersonate any person or entity
  • Gain unauthorized access to the Service or other accounts
  • Use automated means (bots, scrapers) to access the Service
  • Interfere with or disrupt the Service
  • Circumvent security features or usage limits
  • Reverse engineer or attempt to discover source code or algorithms
  • Exceed usage limits or create multiple accounts to evade limits
  • Use the Service commercially on non-commercial plans
  • Resell or redistribute access without written consent

5.3 Enforcement

We may monitor, remove content, suspend or terminate accounts, and report illegal activity.

6. User Content and Generated Output

6.1 User Content Ownership

You retain ownership of original uploads but grant us a worldwide, non-exclusive, royalty-free license to use, process, and display your User Content solely to provide, maintain, improve, and promote the Service.

6.2 User Content Warranties

By uploading, you warrant that:

  • You own or have necessary rights to upload
  • Your content doesn't violate third-party rights
  • Your content doesn't violate laws
  • Your content contains no viruses or harmful code

6.3 Generated Previews

  • Ownership: You receive a non-exclusive, non-transferable license subject to plan restrictions
  • Non-Exclusivity: Previews may be similar to other users' previews
  • Watermarks: May be applied depending on plan
  • Commercial Use: Permitted only on designated commercial plans
  • No Quality Guarantee: No guarantee of quality, accuracy, usability, or fitness for purpose

6.4 Prohibited Content

No illegal, violent, explicit, infringing, or harmful content. We may remove violating content without notice.

6.5 Content Deletion

We may automatically delete content after defined retention periods. Upon termination, all content is deleted per our Privacy Policy.

7. Intellectual Property Rights

7.1 Company Ownership

The Service, including software, technology, algorithms, AI models, interfaces, and branding (excluding User Content), is owned by or licensed to DecorViz AI and protected by intellectual property laws.

7.2 Restrictions

You may not copy, modify, distribute, reverse engineer, remove notices, or create derivative works based on the Service.

7.3 Trademarks

"DecorViz AI" and our logos are trademarks. Use requires prior written permission.

8. Feedback

If you provide feedback, suggestions, or ideas, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, modify, and commercialize such feedback without compensation or attribution.

9. Paid Features and Subscriptions

Certain features require payment. All payments are governed by our Payment & Billing Policy, incorporated by reference. Key terms:

  • Generally non-refundable except as stated in Payment & Billing Policy
  • Subscriptions auto-renew unless cancelled
  • You are responsible for applicable taxes
  • We may change pricing with notice
  • We may suspend access for non-payment

10. Service Availability and Modifications

10.1 "As Is" Basis

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES.

10.2 Service Variability

Generation times, success rates, and quality are highly variable. You acknowledge:

  • Generation may take significantly longer than expected
  • Generations may fail and require retries
  • Previews may be poor quality, unusable, or unsatisfactory
  • The Service may be unavailable anytime

10.3 Modifications

We may modify, suspend, discontinue, change features, limits, pricing, impose restrictions, or perform maintenance at any time without notice or liability.

11. Termination and Suspension

11.1 Termination by You

You may terminate anytime. No refund except as stated in Payment & Billing Policy.

11.2 Termination by Us

We may suspend or terminate immediately without notice for any reason, including:

  • Violation of Terms or law
  • Fraudulent, abusive, or harmful conduct
  • Non-payment
  • Legal requirement
  • Our decision to discontinue Service

Upon termination, access ceases, licenses terminate, we may delete data, and you remain liable for prior fees.

11.3 Survival

Intellectual property, disclaimers, liability limitations, indemnification, and governing law provisions survive termination.

WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, AND THOSE ARISING FROM COURSE OF DEALING OR USAGE.

12.2 No Guarantee of Results

WE MAKE NO REPRESENTATIONS THAT:

  • The Service will meet your requirements
  • The Service will be uninterrupted, timely, secure, or error-free
  • Previews will be accurate, realistic, high-quality, or fit for any purpose
  • Previews will match real-world results
  • Defects will be corrected
  • The Service is free of viruses

12.3 AI Limitations

YOU ACKNOWLEDGE:

  • AI content is probabilistic, unpredictable, and subject to errors, hallucinations, and distortions
  • Previews are visual approximations only and may contain significant inaccuracies
  • The Service cannot guarantee realistic or accurate results
  • Generation times and success vary widely with possible delays or failures
  • The Service is not a substitute for professional advice, inspection, or measurement

12.4 Not Professional Advice

THE SERVICE DOES NOT PROVIDE PROFESSIONAL DESIGN, INTERIOR DESIGN, CONSTRUCTION, PURCHASING, SAFETY, OR DECISION-MAKING ADVICE. DO NOT RELY ON PREVIEWS AS THE SOLE BASIS FOR DECISIONS. CONSULT QUALIFIED PROFESSIONALS.

12.5 Third-Party Content

We are not responsible for accuracy, availability, quality, safety, or legality of products from third-party sources. We do not endorse any products or retailers. Purchase decisions are your sole responsibility.

12.6 No Guarantee of Non-Infringement

WE DO NOT WARRANT THAT PREVIEWS ARE FREE FROM THIRD-PARTY IP CLAIMS OR THAT YOUR USE WON'T INFRINGE RIGHTS.

13. Limitation of Liability

  • Loss of goodwill or reputation
  • Cost of substitute goods or services
  • Personal injury or property damage
  • Damages from reliance on Previews
  • Damages from purchasing decisions based on the Service

THIS APPLIES REGARDLESS OF LEGAL THEORY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, WARRANTY) EVEN IF WE WERE ADVISED OF POSSIBLE DAMAGES.

13.2 Cap on Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS SHALL NOT EXCEED THE GREATER OF:
(A) THE TOTAL AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT, OR
(B) ONE HUNDRED US DOLLARS ($100)

YOU ACKNOWLEDGE THESE DISCLAIMERS AND LIMITATIONS REFLECT A REASONABLE ALLOCATION OF RISK AND THAT WE WOULD NOT PROVIDE THE SERVICE WITHOUT THESE LIMITATIONS.

14. Indemnification

You agree to indemnify, defend, and hold harmless DecorViz AI, its affiliates, officers, directors, employees, agents, licensors, and suppliers from any claims, liabilities, damages, losses, costs, or fees (including attorneys' fees) arising from:

  • Your use or misuse of the Service
  • Your User Content, including infringement claims
  • Your violation of these Terms or applicable law
  • Your violation of third-party rights
  • Any fraudulent, negligent, or willful misconduct by you

We may assume exclusive defense and control of any indemnified matter. This obligation survives termination.

15. Governing Law and Dispute Resolution

These Terms shall be governed by laws that will be specified once the company is formally established and registered.

No waiver of any term constitutes continuing waiver. Our failure to enforce any right doesn't constitute waiver.

You may not assign these Terms without our written consent. We may freely assign these Terms. Attempted unauthorized assignment is void.

16.5 Force Majeure

We are not liable for failure or delay due to causes beyond reasonable control, including acts of God, war, terrorism, pandemics, or infrastructure failures.

16.6 Independent Contractors

You and DecorViz AI are independent contractors. These Terms create no partnership, employment, or agency relationship.

16.7 No Third-Party Beneficiaries

These Terms benefit only you and DecorViz AI and confer no rights to third parties.

16.8 Notices

Notices to you may be by email or posting on the Service. Notices to us should be sent via our contact information.

16.9 Language

These Terms are in English. If translated, the English version prevails in any conflict.

16.10 Headings

Headings are for convenience only and have no legal effect.

17. Changes to These Terms

We may modify these Terms anytime. Material changes will be communicated via prominent notice on the Service or email at least 30 days before effective date. Continued use after effective date constitutes acceptance. If you disagree, stop using the Service and may terminate your account.
